2. Description of Service
Paybird provides automated payment recovery, dunning management, churn reduction, and self-service billing portal services for subscription-based businesses.
3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information when creating an account
- Maintain the security of your account credentials
- Use our services only for lawful purposes
- Comply with all applicable payment processing regulations
- Maintain confidentiality of all customer information
- Not use our services to engage in fraudulent or deceptive practices

You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access to your account.
5. Payment Terms
You agree to pay all fees associated with your use of our services. Fees are non-refundable except as required by law or as specified in our refund policy.
6. Data Privacy
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our data practices as described therein.
7. Intellectual Property
All content, features, and functionality of Paybird are owned by us and are protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
Paybird shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim.
9. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind. While we strive for accuracy, we do not guarantee uninterrupted or error-free service.
10. Indemnification
You agree to indemnify and hold harmless Paybird from any claims, damages, or expenses arising from your use of our services or violation of these terms.
11. Termination
We may terminate or suspend your account at any time for violation of these terms or for any other reason. Upon termination, your right to use our services ceases immediately.
12. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
13. Governing Law
These terms shall be governed by the laws of the State of New Mexico without regard to conflict of law principles.
14. SMS Terms and Conditions
By opting in to SMS communications from PayBird, you consent to receive recurring automated text messages at the mobile number you provided. These messages may include:
- Account verification codes and one-time passcodes
- Account status updates and security alerts
- Payment recovery notifications and billing reminders
- Service-related announcements
Message frequency: Message frequency varies based on account activity. You may receive up to 10 messages per month depending on your account status and recovery events.
Message and data rates may apply. Your mobile carrier's standard messaging and data rates may apply to messages you send and receive. PayBird is not responsible for any fees charged by your carrier.
Opt-out: You may opt out of SMS communications at any time by replying STOP to any message you receive from us. After opting out, you will receive one final confirmation message. You will no longer receive SMS messages from PayBird unless you re-subscribe.

Consent to receive SMS messages is not a condition of purchasing any goods or services from PayBird. You may use our platform and services without opting in to SMS communications.
Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and other major US carriers. Carriers are not liable for delayed or undelivered messages.
